protecting and respecting your privacy. Serendipity operates a mobile
safety application that allows users to view other people's locations
and share locations with friends and family. This Privacy Policy
explains our practices regarding the collection, use, disclosure, and
processing of personal data.
Serendipity operates a service that allows you to view other people’s
locations and share your locations with people you know like your family
or friends. A user’s precise location is never broadcast to distant
“degrees” unless they have intentionally agreed to connect with another

HOW WE COLLECT AND USE INFORMATION

Registration and Profile Information. When you
create an account, we may collect your personal information such as your
username, first and last name, email address, mobile phone number,
things you like, more about yourself, company name where you work, age,
home address, phone contact list and a photo, if you chose to have a
photo associated with your account. Also credit card and other
payment information may be collected, but not stored unless you allow us
to.
Data collected through use of the Service. After
you set up your account, we may ask for other profile and demographic
information, such as your address and instructions and information, and
nickname. You may also customize your map by labeling locations, such as
“work” and “home,” to make it easy to pin locations on a map and save
addresses of others. provide alerts when family members leave and
arrive.
Geolocation. We collect your location
information through your device IP address, WiFi, Bluetooth, and GPS
coordinates (e.g., latitude/longitude) available through your mobile
device. We may also gather information about your location using other
technologies and sensors which may provide us with information about
nearby devices, WiFi access points and networks, and nearby cell towers.
We collect and maintain location data to provide you the features and
functionality of the Service. Please note that turning off the Broadcast
Location option on our Service or turning off Location Services or
logging out of the app will impact the ability of others to track your
location. We may also share location information with third parties for
advertising, research, analytic and other purposes. If you want to
opt-out of the collection of your location data, please adjust your
settings in your mobile device to limit the app’s access to your
location data. Please see “Your Choices About Your Information” below to

Motion Event Data. We collect, and may use a
third party partner to collect, sensory and motion data from your
smartphone or mobile device, including information from the gyroscope,
accelerometer, compass and Bluetooth, in order to calculate and detect
motion events such as speed and other events. Your mobile device
provider may refer to this information as ““Motion and Fitness” data
(description may vary according to device and platform). If you want to
opt-out of the collection of your sensory and motion, please adjust your
settings in your mobile device to limit the app’s access to your sensory
and motion data but please know that the ability for us to show your
location data and the accuracy may be impacted. Please see “Your Choices
About Your Information” below to learn more.
Messages and User Content. We collect
information when you message other members who use our service. We may
also keep any messages you send to us.
We use this information to provide to you the features and
functionality of the Service and to communicate directly with you, such
as to send you alerts on the movements of your connections and others
connected to you through some degree of separation or others you may not
know.
Social Media. When you work with our site
through various social media, such as when you like us on Facebook or
follow us on Instagram or X or post a comment to our Facebook, X or
Instagram pages, we may receive information from the social network such
as your profile information, profile picture, gender, user name, user ID
associated with your social media account, age range, language, country,
friends list, and any other information you permit the social network to
share with third parties. The data we receive is dependent upon your
privacy settings with the social network. You should always review, and
if necessary, adjust your privacy settings on third-party websites and
services before linking or connecting them to Serendipity’s website or
Service.
Information we collect automatically through the use of
technology. When you visit our website, use our mobile app,
read our emails or otherwise engage with us, we and our business
partners may automatically collect certain information about your
computer or device through a variety of tracking technologies, including
cookies, web beacons, log files, embedded scripts, location-identifying
technologies, or other tracking/recording tools (collectively, “tracking
technologies”), and we may combine this information with other personal
information we collect about you. We use these tracking technologies to
collect usage and device information, such as:
Information about how you access the Service, how frequently you
access the Service, whether you open emails or click the links contained
in emails, whether you access the Service from multiple devices, and
other actions you take on the Service.
Information about how you use the Service, for example, the

similar actions.
Information about the computer, tablet, smartphone or other
device you use, such as your IP address, browser type, Internet service
provider, platform type, device type/model/ manufacturer, operating
system, phone number, mobile carrier, date and time stamp, a unique ID
that allows us to uniquely identify your browser, mobile device or your
account (including, for example, Google AdID, Windows Advertising ID or
other persistent device identifier or Ad ID), battery life, and other
such information. With your permission, we may also access your photo or
camera roll.
We may collect analytics data, or use third-party analytics tools
such as Google Analytics or Mixpanel, to help us measure traffic and
usage trends for the Service and to understand more about the

We use this information to remember information so that you will not
have to re-enter it during your visit or the next time you visit the

identify and contact you across multiple devices; provide and monitor
the effectiveness of our Service and our marketing campaigns; monitor
aggregate metrics such as total number of visitors, users, traffic, and
demographic patterns; diagnose or fix technology problems reported by
our Users or engineers that are associated with certain IP addresses or
User IDs; and detect or prevent fraud or other harmful activities;
automatically update our mobile application on your system and related
devices; and otherwise plan for and enhance our Service.
If you would prefer not to accept cookies, most browsers will allow
you to: change your browser settings to notify you when you receive a
cookie, which lets you choose whether or not to accept it; disable
existing cookies; or set your browser to automatically reject cookies.
Please note that doing so may have an impact your experience using the
Service, as some features and services on our Service may not work
properly. Depending on your mobile device and operating system, you may
not be able to delete or block all cookies. These browser settings that
block cookies may have no effect on non-cookie technologies. You may
also set your e-mail options do the same thing. We will do our best to
honor the privacy preferences of our Users. At this time, we are not
able to respond to Do Not Track signals from your browser.
We may use UXCam, which is an analytics solution. UXCam may record:
Screens visited, Interaction patterns (such as screen actions, gestures:
taps, scrolls), and Device details (Type, Version, Model, Operating
System). We are using the information collected by UXCam to improve our
app.
UXCam does not collect personally identifiable information and does not
track your browsing habits across apps. For more information see UXCam’s

ensure that these parties process data under strict Data Processing
Agreements (DPA’s) or Standard Contractual Clauses (SCC’s).
We also work with Zendesk and your data may be transferred there as

We and our third-party partners may also use information collected
through tracking technologies for advertising purposes. Please see

2. Description and Purpose of Data Processing
Serendipity, Inc. processes mobile geolocation data and mobile device
identifiers received from users of our safety tracking mobile
application. We collect this data to provide real-time location tracking
features for user safety. This covered personal data is disclosed to
third-party data commercialization partners and data brokers, who
contractually anonymize and aggregate the geolocation data for market
research, analytics, and commercial mapping purposes.
SELLING AND SHARING OF YOUR INFORMATION
Serendipity sells your personal data to commercial third parties.
Specifically, we sell precise background geolocation coordinates
(latitude and longitude), driving speed, device motion event data, and
unique mobile advertising identifiers (such as Google ADID and Apple
IDFA) to third-party data brokers and advertising networks for
commercial profiling, targeted marketing, and market research. You have
the absolute right to opt out of the sale or sharing of this information
at any time.
Any information or content that you voluntarily post to the website
or to our Facebook or other social media pages will automatically be
available to the public. We may publicly post your reviews and comments
online on our website or mobile app, or link your reviews to third party
websites. Furthermore, you grant a license to us to use reviews and
comments, in perpetuity on our website, unless you notify us in
writing.

Unless specified otherwise, all Data requested by Serendipity,
Inc is mandatory and failure to provide this Data may make it impossible
for Serendipity, Inc to provide its services. In cases where
Serendipity, Inc specifically states that some Data is not mandatory,
Users are free not to communicate this Data without consequences to the
availability or the functioning of the Service.

Any use of Cookies – or of other tracking tools — by Serendipity,
Inc. or by the owners of third-party services used by Serendipity, Inc.
serves the purpose of providing the Service required by the User, in
addition to any other purposes described in the present document and in
the Cookie Policy.
Users are responsible for any third-party Personal Data obtained,
published or shared through Serendipity, Inc.
Device permissions for Personal Data access:
Depending on the User's specific device, Serendipity, Inc may request
certain permissions that allow it to access the User's device Data as
described below.
By default, these permissions must be granted by the User before the
respective information can be accessed. Once the permission has been
given, it can be revoked by the User at any time. In order to revoke
these permissions, Users may refer to the device settings or contact the

The exact procedure for controlling app permissions may be dependent
on the User's device and software. Please note that the revoking of such
permissions might impact the proper functioning of Serendipity, Inc. If

will respond to your request
We will strive to promptly respond to your requests.
In any case, should it be impossible for us to do so, we’ll make sure to
communicate to you the factual or legal reasons that prevent us from
immediately, or otherwise ever, complying with your requests. In cases
where we are not processing your personal information, we will indicate
to you the physical or legal person to whom you should address your
requests, if we are in the position to do so.
In the event that you file an access or personal
information processing confirmation request, please
make sure that you specify whether you’d like your personal information
to be delivered in electronic or printed form.
You will also need to let us know whether you want us to answer your
request immediately, in which case we will answer in a simplified
fashion, or if you need a complete disclosure instead.
In the latter case, we’ll respond within 15 days from the time of your
request, providing you with all the information on the origin of your
personal information, confirmation on whether or not records exist, any
criteria used for the processing and the purposes of the processing,
while safeguarding our commercial and industrial secrets.
In the event that you file a rectification, deletion,
anonymization or personal information blocking request, we will
make sure to immediately communicate your request to other parties with
whom we have shared your personal information in order to enable such
third parties to also comply with your request — except in cases where
such communication is proven impossible or involves disproportionate
effort on our side.
We are allowed to transfer your personal information outside of the
Brazilian territory in the following cases:
when the transfer is necessary for international legal
cooperation between public intelligence, investigation and prosecution
bodies, according to the legal means provided by the international
law;
when the transfer is necessary to protect your life or physical
security or those of a third party;
when the transfer is authorized by the ANPD;
when the transfer results from a commitment undertaken in an
international cooperation agreement;
when the transfer is necessary for the execution of a public
policy or legal attribution of public service;
when the transfer is necessary for compliance with a legal or
regulatory obligation, the carrying out of a contract or preliminary
procedures related to a contract, or the regular exercise of rights in
judicial, administrative or arbitration procedures.
In any case, the Owner will gladly help to clarify the specific legal
basis that applies to the processing, and in particular whether the
provision of Personal Data is a statutory or contractual requirement, or
a requirement necessary to enter into a contract.
Unless specified otherwise in this document, Personal Data shall be
processed and stored for as long as required by the purpose they have
been collected for and may be retained for longer due to applicable
legal obligation or based on the Users’ consent.
Therefore:
Personal Data collected for purposes related to the performance
of a contract between the Owner and the User shall be retained until
such contract has been fully performed.
Personal Data collected for the purposes of the Owner’s
legitimate interests shall be retained as long as needed to fulfill such
purposes. Users may find specific information regarding the legitimate
interests pursued by the Owner within the relevant sections of this
document or by contacting the Owner.
The Owner may be allowed to retain Personal Data for a longer period
whenever the User has given consent to such processing, as long as such
consent is not withdrawn. Furthermore, the Owner may be obliged to
retain Personal Data for a longer period whenever required to fulfil a
legal obligation or upon order of an authority.
Once the retention period expires, Personal Data shall be deleted.
Therefore, the right of access, the right to erasure, the right to
rectification and the right to data portability cannot be enforced after
expiration of the retention period.
HOW WE PROTECT YOUR INFORMATION
Serendipity cares about the security of your information and uses
commercially reasonable physical, administrative, and technological
safeguards to preserve the integrity and security of all information we
collect and that we share with our service providers. However, no
security system is without safety concerns and we cannot guarantee that
our systems to be fool proof. In the event that any information under
our control is compromised as a result of a breach of security, we will
take reasonable steps to investigate the situation and where
appropriate, notify those users whose information may have been
compromised and take other steps, in accordance with any applicable laws
and regulations.
YOUR CHOICES ABOUT YOUR INFORMATION
You may, of course, decline to submit any personal information
through the Service, in which case Serendipity may not be able to
provide its Services to you.
Modifying Your Account Information and Settings: You
may modify your account information, update or amend your personal
information, or change your password at any time by logging in to your
account. If you have any questions about reviewing or modifying your
account information, you can contact us directly

Delete Your Account and Personal Information: We
will retain your information for as long as your account is active or as
needed to provide you services. If you wish to cancel your account,
please click on “Delete Account” at the very bottom of the Account
Settings page on the Mobile Service.
Emails and Notifications: You can control your
receipt of email and text alerts by visiting “Settings” and “Alert
Options” within the mobile app. You can also stop receiving promotional
email communications from us by clicking on the “unsubscribe” link
provided in such communications. We make every effort to promptly
process all unsubscribe requests. We may also send you Service-related
emails (e.g., account verification, order confirmations, change or

data to provide the Serendipity Services, and may share your personal
information, including location data, with other Serendipity users in
your contact list or with other Serendipity App Users, and with third
parties for advertising or other purposes.
Limit location sharing with your contacts, other Users on
Serendipity and with those who are tracking you. You may turn
location sharing “OFF” on the mobile application for those who track you
or you can turn Broadcast Location OFF to not share your location with
anyone on our Service. You can also turn off location sharing with
groups you create on our Service. If you turn off location sharing we
will not share your location, however, we will continue to collect your
location information in order to provide the Service (for example, to
the people who you do want to share your location).
Limit location collection and sharing. You can
opt-out of future sharing of your precise location data with our
third-party partners by adjusting your settings on your mobile device to
prohibit Serendipity from collecting your location data. For example,
depending on your mobile device, you may be able to “Turn location
services ‘off.’ You can also adjust your device settings to withdraw
permission for the Serendipity app to access location data. We and our
third-party partners may continue to approximate your location based on
other data. Please note that your Serendipity app may not be able to
provide all of our Services to you if you disable access to location
data through your device settings.
Driving Event and Movement Data: We collect driving
event and movement data (such as accelerometer data, magnetometer data,
gyro data, etc.) from your mobile device in order to identify driving
event and behaviors and provide certain functionality of the Services.
We may share your personal information, including driving event and
movement data, with third parties for advertising and other
purposes.
Limit driving event and movement collection and
sharing. You can opt-out of future sharing of your driving
event and movement data with our third-party partners by adjusting your
settings on your mobile device to prohibit Serendipity from collecting
your speed and movement data. For example, depending on your mobile
device, you may be able to withdraw permission for the Serendipity app
to access motion data (depending on the device type, this may be called
“Fitness and Motion” data). Please note that your Serendipity app may
not be able to provide all of our Services to you if you disable access
to motion and movement data through your device settings.
CHILDREN’S PRIVACY
Our Service is strictly prohibited to individuals under the age of
13. We do not knowingly collect, maintain, or sell personal information
– including precise geolocation or motion data – from children under 13
years of age. If we discover that a child under 13 has created an
account, we will immediately terminate the account and permanently
delete all associated data from our servers and our data broker
pipelines. If you believe a child under 13 is using our service, please

Our Service is only meant for people aged 13 and older (if
your local jurisdiction permits it). Any user under this age is
not allowed to use our Service. We comply with local jurisdiction’s

PERSONAL INFORMATION WE COLLECT ABOUT YOU

create or edit your user profile on the Service, update your
preferences, set up geofences around a particular location, correspond
with us by phone, SMS, e-mail or otherwise, or use some other feature of
our Service.
1.2 We will indicate to you where the provision of certain personal
information is required in order for us to provide you certain features
of the Service. If you choose not to provide such personal information,
we may not be able to provide the Service to you or respond to your

your personal information, including your name, location and driving
event data, with other users of our Service at your request and in
accordance with your preferences.
(b) Service providers, business partners and advisors: we may share
your personal information with third party vendors and other service
providers that perform services for us or on our behalf, which may
include providing payment, email or chat services, fraud prevention, web
hosting, or providing analytic services.
(c) Purchasers and third parties in connection with a business
transaction: your personal information may be disclosed to third parties
in connection with a transaction, such as a merger.
(d) Law enforcement, regulators and other parties for legal
reasons: we may share your personal information with third parties as
required by law or if we reasonably believe that such action is
necessary to comply with the law and the reasonable requests of law
enforcement; detect and investigate illegal activities and breaches of
agreements, including our Terms of Service; and/or exercise or protect
the rights, property, or personal safety of Serendipity, its users or

2.3 We may also store your location, and information collected from
your device (such as information generated by the gyroscope and
accelerometer in your device). Serendipity collects information about
your motion detection, such as speed, change in speed and other aspects
of how, how much, where and when your movements are to properly show
your info on SD.
YOUR LOCATION
3.1 We collect information about your location in order to provide
you certain functionalities of the Service.
3.2 We will only collect your location where it is necessary for the
purposes of providing you with the location-based services features of
the app as well as for the legitimate interests of Serendipity or our
business partners, such as for data analytics and geofence tracking
notifications and showing others on our Service. You can modify who sees
your location in the settings of our Service. You can turn off location
sharing by turning off the Broadcast Location feature on our Service .
You can also turn off sharing your location with specific groups you
create on our Service and if so, we will continue to collect your
location information in order to provide you the Service. If you would
like to opt out of the collection of your location information
altogether, please adjust the settings on your mobile device to limit
the app’s access to your location information. If this happens many
features of our Service will not work.
3.3 If you no longer want to continue using the Service, uninstalling
the Serendipity app or logging out from the Service will also stop us
from collecting your location.
MARKETING AND ADVERTISING
4.1 From time to time, we may contact you with information about our
products and services, sent mainly by email or push notifications on
your device.
4.2 We will only send you marketing messages if you have given us
your consent to do so. We will ask you if you would like to receive
these messages when we first collect your contact details.
4.3 You can change your preferences at any time by clicking on the
unsubscribe link at the bottom of our marketing literature.
4.4 Please note that if you do opt-out of or do not grant consent to
receiving marketing related messages from us, we may still send you
non-marketing messages, such as communications relating to the provision
of our Service or anything else that may be legally required to
send.
STORING AND TRANSFERRING YOUR PERSONAL INFORMATION

Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S.
Department of Commerce. Serendipity, Inc. has certified to the U.S.
Department of Commerce that it adheres to the EU-U.S. Data Privacy
Framework Principles (EU-U.S. DPF Principles) with regard to the
processing of personal data received from the European Union in reliance
on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in
reliance on the UK Extension to the EU-U.S. DPF. Serendipity, Inc. has
certified to the U.S. Department of Commerce that it adheres to the
Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles)
with regard to the processing of personal data received from Switzerland
in reliance on the Swiss-U.S. DPF. If there is any conflict between the
terms in this privacy policy and the EU-U.S. DPF Principles and/or the

should first contact Serendipity, Inc. at privacy@serendipity.app.
Serendipity, Inc. has further committed to refer unresolved DPF
complaints to the EU Data Protection Authorities
(DPAs), the UK Information Commissioner’s Office
(ICO), and the Swiss Federal Data Protection and
Information Commissioner (FDPIC), which act as our independent
alternative dispute resolution providers. If you do not receive timely
acknowledgment of your complaint from us, or if we have not addressed
your complaint to your satisfaction, please contact the relevant EU, UK,
or Swiss authorities directly to file a complaint at no cost to you.
8.4. Regulatory Enforcement and Arbitration
The Federal Trade Commission (FTC) has jurisdiction over Serendipity,
Inc.’s compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S.
DPF, and the Swiss-U.S. DPF. Under certain conditions, more fully
described on the Data Privacy Framework website, you may invoke binding
arbitration when other dispute resolution procedures have been
exhausted.
This section applies to Users in Switzerland, and, for such Users,

11. INTERNATIONAL DATA TRANSFERS & DATA PRIVACY FRAMEWORK
COMPLIANCE
Participation and Certification
Serendipity Inc. (“Company,” “we,” or “our”) complies with the
EU-U.S. Data Privacy Framework (EU-U.S. DPF), the
UK Extension to the EU-U.S. DPF, and the
Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as
set forth by the U.S. Department of Commerce. We have certified to the
U.S. Department of Commerce that we adhere to the EU-U.S. Data Privacy
Framework Principles (“EU-U.S. DPF Principles”) regarding the processing
of personal data received from the European Union in reliance on the
EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on
the UK Extension to the EU-U.S. DPF. We have certified to the U.S.
Department of Commerce that we adhere to the Swiss-U.S. Data Privacy
Framework Principles (“Swiss-U.S. DPF Principles”) regarding the
processing of personal data received from Switzerland in reliance on the
Swiss-U.S. DPF. If there is any conflict between the terms in this
privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF
Principles, the Principles shall govern. To learn more about the Data

Regulatory Oversight & Enforcement
The U.S. Federal Trade Commission (FTC) has enforcement
jurisdiction over Serendipity Inc.’s compliance with the EU-U.S. DPF,
the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.
Accountability for Onward Transfers (Third-Party Data
Disclosures)
Serendipity Inc. commercializes and sells precise, real-time background
geolocation coordinates, device motion data, velocity metrics, and
mobile advertising identifiers (such as Apple IDFA or Google AdID) to
third-party data brokers and advertising networks. Under the DPF
Principles, Serendipity Inc. remains strictly liable if a third-party
agent or commercial data broker processes such sensitive information in
a manner inconsistent with the DPF Principles, unless we can legally
prove we are not responsible for the event giving rise to the damage. We
strictly mandate that all data broker partners execute data protection
agreements guaranteeing equivalent privacy rights.
Individual Rights & Choice
If you reside in the EEA, UK, or Switzerland, you have the right to
access, correct, port, or request erasure of your location data. We do
not track or share your information by default. We provide a strict,
unbundled Opt-In agreement prompt inside the user
interface before processing location data. You can completely revoke
your consent or completely opt out of onward data broker transfers at
any time via the "Account Settings" toggle within the mobile app or via
our homepage at Serendipity.app.
Inquiries and Dispute Resolution
In compliance with the DPF Principles, we commit to resolve complaints
about our collection and processing of your personal information. EEA,
UK, and Swiss individuals with inquiries or complaints regarding our
handling of personal data should first submit a formal ticket to: privacy@serendipity.app.
For any unresolved privacy or data usage complaints that we have not
addressed satisfactorily, we have committed to cooperate and comply
directly with the advice of the panel established by the EU Data
Protection Authorities (DPAs), the UK Information
Commissioner’s Office (ICO), and the Swiss Federal Data
Protection and Information Commissioner (FDPIC) with respect to
unresolved complaints concerning our handling of personal data received
in reliance on the DPF frameworks. These independent oversight services
are provided completely free of charge to you.
Binding Arbitration Option
Under certain specific conditions, more fully described on the
official Data Privacy Framework website, you may invoke binding
arbitration through the ICDR-AAA DPF Annex I Binding Arbitration
Mechanism after other consumer dispute resolution pathways have been
entirely exhausted. [1]

Our Service may, from time to time, contain links to and from third
party websites, including those of other users, our partner networks,
advertisers, partner merchants and affiliates. If you follow a link to
any of these websites, please note that these websites have their own
privacy policies and that we do not accept any responsibility or
liability for their policies. Please check the individual policies
before you submit any information to those websites.
Not a Replacement for Emergency Services
Serendipity is not an emergency response application. The Service
relies entirely on third-party mobile network connectivity, device
battery power, and commercial GPS hardware. We do not guarantee
real-time delivery of alerts. Serendipity does not dispatch emergency
services (such as 911, police, or medical responders) and is never a
substitute for official emergency response channels. You use this
application entirely at your own risk."
As-Is Data Broker Processing Indemnification
While Serendipity mandates strict data protection contracts with
authorized downstream partners, we do not own, control, or operate
third-party data brokers or advertising networks. We explicitly disclaim
all liability for any independent data breaches, data mishandling, or
unlawful profiling executed by external third-party buyers after data
transfer has occurred in accordance with your explicit in-app
consent.
Governing Law and Forum Selection
A. Forum Selection
Except for residual international data privacy claims explicitly
governed by the Data Privacy Framework (DPF) Annex I Binding Arbitration
Mechanism detailed in Section 11 of this Policy, you agree that any and
all legal disputes, claims, or lawsuits arising out of our data
collection, storage, privacy practices, or your use of Serendipity shall
be brought exclusively in the State or Federal courts located within the
County of Los Angeles, State of California, USA. You hereby irrevocably
submit to the personal jurisdiction and venue of these courts and waive
any defense of an inconvenient forum.
B. Multi-State Class-Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL CLAIMS AND LEGAL ACTIONS
MUST BE PROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR
CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE
ATTORNEY GENERAL ACTION, OR REPRESENTATIVE PROCEEDING OF ANY KIND. YOU
EXPLICITLY AGREE TO WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO
PARTICIPATE IN A CLASS-WIDE LAWSUIT.
Absolute Limitation of Liability Cap
In no event shall Serendipity Inc., its directors, or partners be
liable for any indirect, incidental, punitive, or consequential damages
resulting from data breaches, server downtime, location inaccuracies, or
data broker processing. Our total liability to you for any claims
arising out of this agreement or your use of the app shall not exceed
$100 USD (or the total amount you have paid us in the last 12 months,
whichever is greater)
OUR POLICY TOWARDS CHILDREN
17.1 The Service may only be used by children age 13 or older and in
some countries the age is older, as shown in Annex 3.
17.2 The age at which children need parental consent varies between
EEA Countries. Please refer to Annex 3 to verify the
minimum age at which children no longer need consent to use our
Service.
17.3 If you become aware that your child under the Minimum Age has
signed up for an account and provided us with personal information,
without your consent, then please contact us at privacy@serendipity.app
so that we can take steps to remove such information and terminate any
account your child has created with us.
CHANGES TO THIS POLICY
We may update this privacy policy from time to time and so you should
review this page periodically. When we change this privacy policy in a
material way, we will update the “last modified” date at the end of this
privacy policy. Changes to this privacy policy are effective when they
are posted on this page.

for legal, marketing or other business-related purposes, we will select
